The importance of challenging CQC reports for a fair outcome

Laura Shelton, Partner and Head of Healthcare Regulatory at HCR Law

Laura Shelton, Partner and Head of Healthcare Regulatory at HCR Law, highlights the crucial importance of challenging Care Quality Commission reports to ensure fair outcomes.

For healthcare providers, the Care Quality Commission (CQC) can be a daunting body to deal with. As regulators, they oversee standards across the health and social care sector through a variety of monitoring, inspecting and rating services.

Their decisions, often based on inspections carried out at premises, can have long-lasting effects. Where decisions are detrimental to care businesses or the people who are employed by them – for example through workforce or leadership recommendations – it is important to be able to challenge these where appropriate. Through challenging decisions made by the CQC, providers are able to put their side of the argument forward, with a view to clarifying and resolving any concerns.

However, in order to challenge often potentially damaging CQC reports and decisions before they become unmanageable – for example if reports are made public, leading to coverage in newspapers – it is important to have the right legal experts in your corner throughout the process.

HCR Law has recently welcomed a team of healthcare regulatory specialists to its large Healthcare team. The team’s combined expertise spans the entire health and social care regulatory sector – with a particular focus on CQC enforcement and registration. Importantly, the team don’t act for any regulatory bodies, meaning their focus is always solely on the provider. This new addition to the firm will further cement HCR Law’s place in the health and social care market, adding to an already market-leading service.

While CQC reports and decisions can be difficult to manage, with the right support these can be challenged, ensuring care providers’ and their staff’s reputation in the sector is maintained.
